The U.S. Citizenship and Immigration Services (USCIS), the Department of Homeland Security (DHS) have offered a legal way for Venezuelans to immigrate to the United States. The new TPS was put into effect last March and runs for 18 months through September 2022.
The humanitarian crisis that has developed in Venezuela has prompted the US government to add Venezuela to the list of countries that are qualified for immigration under TPS. Time is of the essence when making an application.
Who is eligible for TPS?
Nationals of Venezuela, even if they were born elsewhere, can qualify if they have habitually lived in Venezuela. To qualify, applicants must have continuously lived in the United States since March 8, 2021, to apply for TPS. TPS allows Venezuelans who are already in the USA to stay longer under protected status.
What is the registration deadline?
The 180-day registration period for eligible individuals to submit TPS applications begins March 9, 2021, and will remain in effect through Sept. 5, 2021.
Can Venezuelans work in the USA under TPS?
Yes. Employment Authorization Document (EAD) gives Venezuelan immigrants under TPS the right to legally work while in the United States.
What is DED status?
Along with the TPS supplication, Venezuelans are also qualified for Deferred Enforced Departure (DED). DED protects Venezuelan from being deported while in the USA. On Jan. 19, 2021, a presidential memorandum gave DED status to Venezuelans. Under DED and EAD, Venezuelans can work and stay in the U.S. without fear of deportation.
